Privacy Policy

1. Introduction
This Privacy Policy applies to mobile apps (“Applications”) developed by Disparate Elements LLC (“Disparate Elements”). We respect your privacy rights and value your trust. This Privacy Policy describes how we collect, receive, use, store, share, transfer, and process your personal information, as well as your rights in determining what we do with the information that we collect or hold about you.
For the purpose of this Privacy Policy: (i) any reference to “Customer(s)” means end users who have interacted with Disparate Elements’ Applications; and (ii) any reference to “Disparate Elements” “we” “us” or “our” shall mean Disparate Elements LLC.Details and specifics are provided below, but to summarize: We assign users a randomized user ID and, with your consent, use that identifier to monitor app usage data to help us understand and optimize our Applications. We do not perform “tracking” and do not share data with third parties.2. Customer Data Received and Processed by Disparate Elements
When a Customer uses the Applications, the following Customer information may be received and processed by Disparate Elements (collectively, “Customer Data”). We strive to minimize the Customer Data collected and only collect the information that we need for approved and lawful purposes.
While Customer Data does not contain any information that directly identifies an individual, such as names, addresses, credit cards or other similarly regulated financial information, health information, or any other type of sensitive personal information (“PII“), we acknowledge that under certain jurisdictions the Customer Data we do receive may be deemed personal data and therefore, where applicable, will be treated as such.Below are the types of information that we collect:.
- “Technical Information”: this refers to technical information related to a Customer’s mobile device or computer, such as: device type and model, CPU, system language, memory, OS version, Wi-Fi status, time stamp and zone, device motion parameters and carrier.
- “Technical Identifiers”: this refers to various unique identifiers that generally only identify a computer, device, browser or Application. For example, IP address (which may also provide general location information), Application-issued user ID and other similar unique identifiers.
- “Engagement Information”: this refers to information relating to our ad campaigns and Customer actions, such as: clicks on our ads, ad impressions viewed, audiences or segments to which an ad campaign is attributed, the type of ads and the webpage or application from which such ads were displayed, the webpages on our website visited by a Customer, the URL from the referring website, downloads and installations of Applications, and other interactions, events and actions measured within our Application or website (e.g., in-app purchases made, subscriptions, taps, engagement time etc.).
- “Usage Information”: this refers to information collected from your mobile device when our Applications are used. This information includes, but is not limited to, the first time the Application is opened, views of Application features, and button taps. This information is generally used to help us improve our Applications and analytics platform. This software may record information such as how often you use the Application, the events that occur within the Application, aggregated usage, and performance data.
- “Geolocation data”: our Applications do not directly collect geolocation data, and never collect precise GPS coordinates. However, course-grained location information may be derived from IP addresses.
3. How Data is Collected
Customer Data may be collected through various methods, including when provided voluntarily (e.g., emailing app feedback or sending reports to Disparate Elements using an in-app “Report a Bug” feature). Additionally, in order to help us understand how customers use our applications and what advertising is effective, we integrate technology from our partners to collect the data described below:
a. Our partner RevenueCat processes in-app purchases and subscriptions and collects limited Usage Information (such as the date an Application was first opened). For more information about how RevenueCat uses your information, please refer to “End User Information” here https://www.revenuecat.com/privacy/ ;
b. If the Customer elects to “share usage data with the developer” then Technical Information, Technical Identifiers, and Usage Information are collected through our partners Mixpanel and AppsFlyer. This Customer Data is accessible only by the developer.
4. How Data is Used by Disparate Elements
Disparate Elements LLC is the data controller for your information. Consistent with applicable law and choices and controls that may be available to you, we may use information collected from you, or from devices associated with you, to:
a. Provide you with the Applications and products that you request, view, engage with, or purchase;
b. Use mobile analytics software to allow us to better understand the functionality of our Applications on your devices.
c. Operate, understand, optimize, develop, or improve our sites, applications, products, and services;
d. Measure or understand the effectiveness of advertising that we purchase to promote our Applications;
e. Detect, investigate and prevent activities that may violate our policies, pose safety issues, or be fraudulent or illegal;
5. Sharing Data
We do not share or disclose Customer Data with any third party, except:
a. Upon our Customer’s request (e.g., a request to update Customer Data that must be communicated to our Data Processor(s));
b. To our service providers who help to support our Applications – such as data hosting providers and payment processors. These companies are authorized to use your personal information only as necessary to provide these services to us.;
c. When legally required (e.g. court orders or other lawful requests by public authorities), including to meet national security or law enforcement requirements;
d. To respond to, or prevent, fraud or to protect the safety of Disparate Elements, its Customers, or the public;
e As part of any merger or acquisition of Disparate Elements, in which case Customer Data may be transferred to the surviving or acquiring entity.
6. Cross Border Data Transfers
Your information may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.
If you are located outside the United States and choose to use our Applications, please note that we transfer Customer Data to the Unites States and process it there.
Your consent to this Privacy Policy followed by your use of our Applications represents your agreement to that transfer.
Disparate Elements LLC will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security Customer Data.
7. Data Retention
We store the Customer Data we collect as described in this Privacy Policy for as long as you use our Applications, or as necessary to fulfill the purpose(s) for which it was collected, provide our Applications, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
8. Your Privacy Choices and Rights
The laws of certain jurisdictions may provide Customers with various rights in connection with the processing of Customer Data, including:
a. The right to withdraw any previously provided consent;
b. The right to access certain information about you that we process;
c. The right to have us correct or update any Personal Information;
d. The right to have certain Information erased;
e. The right to have us temporarily block our processing of certain Information;
f. The right to have Information exported into common machine-readable format;
g. The right to object to our processing of Information; and
h. The right to lodge a complaint with the appropriate data protection authority.
You may opt out of sharing Usage Information by deselecting “Share usage data with the developer” in the Application settings screen.
If you would like to exercise any of these rights, please contact us as set forth in “Updates and Questions” below. We will process such requests in accordance with applicable laws.
9. Children’s Personal Information
We do not knowingly collect or solicit personal information from children under the age of 16. Our Applications are not directed at children under the age of 16. If a parent or guardian believes that their child under the age of 16 has provided us with personal information online, we ask that a parent or guardian contact us at [email protected]. We will delete that information.
10. Updates and Questions
We may update this Privacy Policy from time to time. Any material changes will be notified to the Customer through the Applications. We will also indicate that an update has occurred on the top of this page so Customers are encouraged to review this Privacy Policy from time to time.
